Elzufon Austin & Mondell’s Workers’ Compensation Department employs attorneys who practice exclusively in the area of workers’ compensation defense. The firm represents a broad spectrum of clients including national and local insurance carriers, third party administrators and self administered/self insureds.

Workers’ Compensation Forms & Resources

Our attorneys are frequently consulted regarding issues of initial compensability, including insurance coverage and whether an employer/employee relationship exists. Once these threshold questions are resolved, we assist and advise on determinations of the type of benefits to which an injured worker is entitled, such as total disability, partial disability, permanent impairment, disfigurement and medical expenses. One of the most frequent issues we are called upon to assist our clients with is evaluation of termination of benefits.

Our firm has participated in thousands of cases involving these issues and others, including attempts to reform prior agreements, calculation of benefits, forfeiture of benefits, commutation of benefits and attempts to rehabilitate an injured worker from both a medical and vocational standpoint.

Not only does the firm have a considerable amount of experience litigating various issues before the Delaware Workers’ Compensation Board, but we have defended and pursued claims on appeal before the Superior and Supreme Courts of Delaware.
